Preface: CONCEPTION:

The length of transition period depends on good will, ideological consensus, reaching of political decision, preparing of framework convention and adapted national projects (with execution intersectional mechanisms), creation of favorable legislative environment, carrying out of monitorial preventive epidemiological control of human health and surrounding environment, food, water, tobacco and daily used products according to WHO recommendations and mandatory sanitary hygienic normative standards of Convention, using the new sources of funding from taxes and fines on health promotion and diseases prevention, coordinated by health and social defense ministry and joint economical management of state and NGO organizations administration and advisory activities.

Consequently, the population would become protected from health hazardous physical, chemical, biological agent's exposure, diseases would be controlled and prevented, population health would be promoted, increasing the mean life time and it's quality, reaching the significant economical effect, fostering the creation of open society, intersectional international integration and progress.

The Framework Convention on Tobacco Control would be accepted in 2002 on WHO Assembly. Joining to Framework Convention by National Legislative Structures would be possible due to December 31, 2002, in order to start the tobacco control, tobacco smoking related diseases prevention, raising of mean life time and it's quality globally since January 1, 2003.

If following the principle, that the active process of preparation of legislative basis for human global protection from health hazardous agents exposure would be started in nearest future, it could be expected, that, execution of it's mechanisms would be possible not earlier than January 1, 2004-2005.

Accepting of liberal 1% taxes on tobacco smoking related diseases, disability and death risk, the taxing reform without the changing of tobacco products realization prices will create the new source of funding for conduction of epidemiological control and preventive measures by State and NGO organizations as well.

Analogically, the prevention taxes for epidemiological control of all kind manufactured, exported or imported products would be established.

Production, with World Trade Organization labeling, consequently tested on International Specialized Commissions Standards according to recommendations of World Health Organization and having the Preventive Epidemiological Control License of International NGO organizations, do not require the additional licensing from member countries. Considering the preventive issues, the randomized epidemiological control of different samples of such products and all kind of manufactured, exported and imported goods would be conducted.

The amount of liberal taxes on diseases and death risk would be estimated on the basis of consensus of joint intersectional decisions, and would be decreased as the content of health hazardous physical, chemical and biological agents doses and concentration falls and finally reach the 0 point for epidemiological healthy production.

Preventive license would not be issued for production, violating the reglamenting border acceptable doses and concentrations. The manufacturing, exporting and importing of such products would be prohibited and confiscated.

Production, not hazardous but even beneficial for human health, would be given by the coordinating organ the preventive license, free from diseases and death risk taxes and become allowed for advertising, after the required testing of all necessary samples. They will pay only expenses for testing and licensing.

The preventive taxes for international license of imported product with World Trade Organization labeling will include the taxes for National Prevention Found. After the notifying on taxes transferring, the coordinating state licensing organization will provide the Customs Prevention Epidemiological Control Office with verification on passing- and importing, trading, distributing and advertising license. In case of transfer of preventive randomized epidemiological control testing taxes with preventive taxes and after the applying of samples, the green light would be given to products passing- and importing, trading, distributing and advertising in the country in terms of preventive, medical and social issues.

State and Public Control should be established on advertisement

Advertisement of tobacco products totally should be prohibited in all means of media, as one of the main type of health hazardous and death causing substance. Advertisement of tobacco products, as main cause of numerous diseases and death, is as unmoral, as advertisement of other narcotic means, such are: heroin, cocaine, opium, marihuana and etc.

Media means, not having possibilities to avoid the financial difficulties by other types of legal business, might be better to close.

In order of diseases prevention, all types of advertisement should be prohibited, without the testing on health hazardous and early death causing physical, chemical and biological agents, documentation on satisfying of reglamenting standards, certification, labeling and health license on advertisement, which would be provided by specialized NGOs conducting the monitorial preventive epidemiological control and licensed according to state organization's recommendations.

Advertisement of products with preventive license media means will conduct according to their considerations.

Recommendations (including health hazardous production anti-advertisement) of Health Care Ministry and specialized licensed NGOs, not containing the elements of any production direct or indirect advertisement and proposed for population health promotion and diseases- and early death prevention, should be free of advertisement fees. Considering the prevention issues, it is preferable that media means ensure the free of charge advertisement of such information with the volume, estimated by legislation.

Due to Health and Social Defense National Program, and according to National Law on Diseases Control & Prevention, Georgia, like the other countries joined to Diseases Control & Prevention Convention, will conduct the state epidemiological control of manufactured and imported, including humanitarian, products with or without the World Trade Organization labeling, and promote the audit control and preventive programs of NGOs by the granting principles.
